Personal Information

Personal information obtained from the customer will be managed appropriately in accordance with the Personal Information Protection Law, other related laws and regulations, and the Privacy Policy and other rules of NTT Advanced Technology Corporation (NTT-AT).

1. When NTT-AT obtains personal information in writing directly from the customer

1.1 NTT-AT will provide the following items of information to the customer in a clear and explicit manner and obtain the customer's consent:

  1. Name of NTT-AT
  2. Name, title, affiliation, and contact point for the Personal Information Protection Manager (or his or her proxy)
  3. Purposes to which the personal information will be put
  4. When it is anticipated that the personal information will be provided to third parties
    • Purposes of providing the personal information to third parties
    • Specifically, what types of personal information will be provided
    • Means or methods of providing the personal information
    • Receivers, or the types and attributes of the organizations that receive the personal information
    • Statement on the existence of any contracts between NTT and the third parties related to the handling of personal information, if any
  5. Statement on plans to outsource the handling of personal information, if any
  6. Statement that NTT-AT will comply with the customer's request if the customer wishes to receive notification on the purposes to which the disclosed personal information will be put, to have any items of personal information disclosed, corrected, added, or deleted, or to exercise his or her rights to reject the use or provision of personal information; and the contact point of NTT-AT for sending such requests.
  7. Statement that the customer provides personal information at his or her discretion; and any consequences of not providing personal information
  8. Statement, in cases where personal information is obtained in a manner that would not make this fact easily recognizable by the customer, that NTT-AT obtains personal information.

1.2 Exceptions

Provisions in 1.1 will not apply in any of the following cases.

  1. When a notification or disclosure of the purposes of using personal information to the customer may injure the customer or harm the life, properties, other rights or interests of the customer.
  2. When a notification or disclosure of the purposes of using personal information to the customer may harm the rights or rightful interests of the corporation involved.
  3. When NTT-AT needs to cooperate with the national government or municipalities in the execution of tasks specified in laws or regulations, and when a notification or disclosure of the purposes of using personal information to the customer may harm the execution of the given tasks.
  4. When the purpose of using personal information is obvious from the circumstances under which NTT-AT obtains the personal information.
  5. When NTT-AT needs to obtain personal information in compliance with the relevant laws or regulations.
  6. When NTT-AT needs to obtain personal information in order to protect the life and properties of the customer or prevent injuries to the customer but it is difficult to obtain consent from the customer.
  7. When NTT-AT needs to obtain personal information in order to enhance public health or promote the proper education of children, but it is difficult to obtain consent from the customer.
  8. When NTT-AT needs to cooperate with the national government, municipalities or their proxy in the execution of tasks specified in laws and regulations, but obtaining consent from the customer may interfere with the execution of the given tasks.

2. When NTT-AT obtains personal information directly from the customer by means other than in writing

When NTT-AT obtains personal information directly from the customer by means other than in writing, NTT-AT will promptly notify or disclose the purposes of using personal information to the customer except for the case where the purposes of using personal information are already publicly disclosed.
However, this provision will not apply in the cases of 1.2a to 1.2d above.

3. Use of personal information of the customer

NTT-AT will use the personal information of the customer solely within the scope required for the achievement of the specified purposes of use.
When NTT-AT uses personal information outside the scope required for the achievement of specified purposes of use, it will notify the customer of the items of information specified in 1.2a to 1.2f above and will obtain consent from the customer.
However, this provision will not apply in cases specified in 1.2e to 1.2h.

4. When NTT-AT contacts the customer using his or her personal information

When NTT-AT contacts the customer using his or her personal information, it will notify the customer of the items of information specified in 1.1a to 1.1f above, and will obtain his or her consent.
However, this provision will not apply in any of the following cases.

  1. When NTT-AT has notified the customer of the items of information specified in 1.1a. to 1.1f above, and has obtained his or her consent.
  2. When NTT-AT is entrusted with the handling of all or parts of personal information, and uses the given personal information solely within the scope of the purposes of its use.
  3. When NTT-AT has been provided with personal information in order to continue the business it has acquired as a result of a merger or for other reasons; the provider of personal information has notified the customer of the items of information specified in 1.1a. to 1.1f above, and has obtained his or her consent; and NTT-AT uses the given personal information solely within the scope of the purposes of its use specified for the business it has acquired.
  4. When NTT-AT shares and uses personal information with a specific partner; the partner has notified the customer of the items of information specified in 1.1a. to 1.1f above, and has obtained his or her consent; and the customer has been notified of the following items of information or is in a position to recognize them easily:
    • The fact that personal information is shared and used by NTT-AT and the partner
    • Items of personal information that are shared and used
    • Users of the shared personal information
    • Purposes of using personal information by the users
    • Name of the person or entity responsible for the management of the personal information that is shared and used
    • Method of obtaining personal information
  5. When, because 1.2d above applies, NTT-AT contacts the customer using personal information obtained without notifying or disclosing the purposes of its use and other information to the customer.
  6. When any of 1.2e to 1.2h applies.

5. Provision of personal information to third parties

NTT-AT appropriately manages personal information obtained from the customer, and will not provide such information to third parties without prior consent from the customer.
However, this provision will not apply in any of the following cases.

  1. When NTT-AT has notified the customer of, or clearly indicated to the customer, the items of information specified in 1.1a. to 1.1d above, and has obtained his or her consent
  2. When it is difficult to obtain consent from every customer because the personal information of a large number of customers is to be provided widely to the public, and the following items of information have been provided to each customer, or some measure having the same effect has been taken.
    • The fact that the purpose of obtaining personal information is to provide it to third parties
    • Items of personal information to be provided to third parties
    • Means or methods of providing personal information to third parties
    • The fact that, at a request of the customer, NTT-AT will suspend the provision of the item of personal information that identifies the individual customer
    • Method of obtaining personal information
  3. When personal information is about officers and stockholders of a corporation or other organization, the personal information is publicly disclosed in accordance with relevant laws and regulations or at the discretion of the persons, the corporation or the organization involved, and the persons, the corporation or the organization involved have been notified of the items of information specified in b, or are in a position to recognize them easily
  4. When NTT-AT outsources the handling of all or parts of personal information solely within the scope of achieving the specified purposes of its use.
  5. When NTT-AT provides personal information to a third party in order for it to continue the business it has acquired as a result of a merger or for other reasons, and it handles the given personal information solely within the scope of the purposes of its use specified in the business it has acquired.
  6. When NTT-AT shares and uses personal information with a specific partner, and the customer has been notified of the following items of information or is in a position to recognize them easily:
    • The fact that NTT-AT and the partner share and use personal information
    • Items of personal information that are shared and used
    • Users of the shared information
    • Purposes of the use of personal information by the users
    • Name of the person or entity responsible for the management of the personal information that is shared and used
    • Method of obtaining personal information
  7. When any of 1.2e to 1.2h applies.

6. Personal information shared and used by NTT-AT and its partners

When NTT-AT and its partners share and use personal information obtained from the customer, NTT-AT will notify the customer of the following items of information.

  • The fact that NTT-AT and the partner will share and use personal information
  • Items of personal information that are shared and used
  • Users of the shared information
  • Purposes of the use of personal information by the users
  • Name of the person or entity responsible for the management of the personal information that is shared and used
  • Method of obtaining personal information
